Terms
What you get when you buy or install a Batten product, and what is expected in return.
These terms cover this website and every product Batten publishes: Shopify themes and apps, and templates and plugins for other platforms. Where a marketplace imposes its own terms on a purchase, those terms apply to the purchase and these terms cover everything around it.
1. Buying
Most Batten products are bought or installed through a marketplace: the Shopify App Store, the Shopify Theme Store, or the marketplace for the platform the product is built for. That marketplace handles the transaction, the invoice, and the payment method.
Where a platform does not process payments for the kind of product being sold, as Framer does not for plugins, the product is listed free and any paid tier is bought through a checkout provider acting for Batten as merchant of record. That provider handles the transaction and the invoice.
2. Your license
A theme or template license covers one production site or store, plus unlimited development and staging previews. You may edit the code for that site. You may not resell, sublicense, or redistribute the product, and you may not use one license across multiple client sites.
An app is licensed per store for as long as it is installed and, where the plan is paid, for as long as the subscription is active.
A plugin licence covers one site. It is activated against that site on first use, and it stays valid for as long as the subscription or the one time licence remains active.
3. What is included
The purchase price covers the product, the documentation on this site, updates published through the marketplace, and support as described below.
4. What is not included
Customization services are not included in the product price. Any paid customization work is arranged separately, is charged separately, and is not covered by the product price or by product support.
Also not included: third party apps or services, content production, migration of an existing store, and hosting.
5. Support
Support covers setting up a product, using its documented settings, and fixing faults in the product itself. Support requests are answered within two business days.
Support does not cover custom code, third party apps, or a theme whose code has been edited. Where a theme's code has been edited, support covers the unedited product.
6. Updates
Updates are published through the same marketplace the product came from. Updates may change or remove a feature where a platform requirement or a security issue makes it necessary. Material changes are recorded on the changelog.
7. Your responsibilities
Back up your theme or site before editing code or applying an update. Keep your own store data. Do not use a Batten product to break the law, to send unsolicited mail, or to breach the rules of the platform you are running on.
8. Acceptable use of this website
Do not attempt to break, overload, or gain unauthorized access to this website. Do not use the support form to send unlawful, abusive, or deliberately misleading content.
9. Availability
This website and the documentation on it are provided as they are, without a guarantee of uninterrupted availability. Products are provided without a warranty that they will meet a particular need or work with a particular third party app.
10. Liability
To the extent the law allows, Batten is not liable for lost profits, lost sales, lost data, or indirect or consequential loss arising from using a Batten product. Where liability cannot be excluded, it is limited to the amount you paid for the product in the twelve months before the claim.
Nothing in these terms limits any right you have that cannot be limited by law, including your rights as a consumer.
11. Ending the agreement
You can stop using a product at any time by uninstalling it or removing it from your site. Batten can end a license where these terms are broken. Refunds after that are governed by the refund policy.
12. Changes to these terms
These terms may change. The date at the top of this page shows when they last did, and material changes are noted on the changelog.
